is it legal, if a school takes away your cell phone, that they can look through your text messages, and pictures, and get into your personal life?
is it legal, for a school to hold you after school hours? today i waited almost half an hour when someone informed me that unless i go in and get my brother he is not allowed to leave because everyone was in trouble for talking, oh and that was PE class. is that stupid or what. you are only not supposed to talk in classes where you need to hear the teacher or where silence is needed for studying.
My little bro and sis go to this extremely stupid private school because my mom is religious, but their policy is insane and makes no sense. Almost everyone working at that school is a power control freak!
And if they dont pray loud enough they get in trouble. Kinda defeats the purpose of religion where you are given a 'choice' doesnt it?
Any help on state or local student rights for Stockton California would be very much appreciated. :)
Update:and another thing is that if you bring a sweater with a hood, they will either take it away or cut the hood off which is somehting new they decided to do. they made this rule because it makes the students look like gang members. but it can look creepy if the sweater is black but my sister had a PINK for goodness sake sweater on and they told her to take it off or she would get into trouble, oh by the way that was on a very cold morning 30 minutes before school. why so early? because we are a single parent family and mom has to go to work. sad they would take away a poor little girls PINK sweater and make her freeze. It is in their policy true, but this is extremely unethical!!! I need this kind of help. They are power control freaks!

well the schools are supposed to post or send to parents the school policy handbook and parents are supposed to go over it with their kids. Kids usually get a copy of rules too.
First off everyone should not be in trouble for a few people talking, that is just not right to punish all for the few. I would take that up with the principal. You don't punish everyone for a few sinners right?
Cell phones shouldn't be used in school, I think alot of schools have that policy. They should be kept in kids pockets or purses and out of sight with ringers off. If someone was talking on it, the school could take it away for the day but not keep it, keeping it represents stealing and in a religious school, the higher powers stealing a kids cell????? And no they have no right to look through it. I would put a password on the phone to prevent that, somehow. They should give it back to the student at the end of the day or call the parent to come get it with a warning not to show it in school again. I see no harm in using it outside of school or between classes, but keep it out of sight in any class. PE is a class and you are being instructed by a teacher to do things so talking during the teachers instructions is a no but otherwise just in the kickball game or whatever should be ok, if they say not then it sounds like a dictatorship school, sports are to socialize and be fun.
These are not your children. Obviously your mother is okay with the school’s policies. If she isn't okay with it, then she can withdraw the children and send them to public school or another private school, but it’s her decision, not yours. And don’t judge her for the decision that she made. She may be willing to agree to stricter rules in order to ensure her children are at a better and/or safer school.
This is a private school, so they can set any policy they choose as long as it’s not illegal, and there’s nothing you’ve stated that’s illegal.
But let me specifically address the last thing you mentioned about the sweater. If the school has a dress code and it’s not adhered to, then they can require the student to remove the article if it’s outerwear or call the parents to come and pick the child up and take them home to change. It's awful that she had to stand outside for 30 minutes in the cold. However, I’ve never known a school, either public or private, that allowed children to be dropped off prior to the doors opening (unless the child was enrolled in a before-school-care program). Their school likely has that policy too, and if so she wasn’t supposed to be standing in front of the school for 30 minutes. I understand Mom had to go to work, but Mom still has an obligation to make arrangements for her child in that situation.
You have no rights as a student; attending school, the legal assumption is that the school (or its proxies) are acting as your parents while you are in their custody. So, if it's legal for a parent to do something, it's legal for the school to, too.
You should ask your brother if he was told "no talking" in PE class, and if he says yes, then ask him if he talked. If he did, whack him upside the head.
Schools should be considerate in implementing its rules and must not be strict with the students. In order to solve this problem, write a letter to the head of the school or talk to your parents regarding this matter so that appropriate actions will be taken.
Your nice guess could be to request to be excused to movie the typhoon. You might consistently say this can be a facet of your study on storms. Leaving elegance to take action could now not always need to come to be a main issue if you happen to get permission first.
This is exactly why I been kicked in and out of school so much.
Kids should have privacy too. Try to get a lock and password for your phone and refuse to give it to them.
